Purpose of Wujj Service/Acceptance of Terms & Conditions
‘Wujj’ designs products and tools that help you achieve your sexual wellness goals and empower and inspire you to optimize your pleasure and arousal. These Terms of Service (“Terms”) apply to your access and use of the ‘Wujj Service’. The “Wujj Service” includes our devices including associated firmware, applications, software, websites, APIs, products, and services.
You must accept these Terms to create a ‘Wujj’ account and to access or use the “Wujj Service”. If you do not have an account, you accept these Terms by using any part of the “Wujj Service”. If you do not accept these terms, do not create an account or use the “Wujj Service”.
Mention of Privacy Policy
For information about our data practices, please see our Privacy Policy, including our Cookie Use statement. By accessing or using the “Wujj Service”, you agree that we can collect and use your information in accordance with the Privacy Policy.
Mention of Copyright Policy
‘Wujj’ respects the intellectual property of others and expects its users to do the same. It is Wujj’s policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who repeatedly infringe the rights of copyright holders. Please see Wujj’s DMCA/Copyright Policy.
Mention of Feedback & Submission Policy
If you submit comments, ideas, or feedback to us, you agree that we can use, disclose, reproduce, distribute, and exploit them without any restriction or compensation to you. We do not waive any rights to use similar or related ideas or feedback previously known to us, developed by ‘Wujj’, or obtained from sources other than you. Our Feedback and Submissions Policy is also part of the Terms.
Responsibilities/Guide to be upheld by participants in study
‘Wujj’ grants you a limited license to access the Mobile App subject to this Agreement. If you choose to subscribe to and use the Mobile App, ‘Wujj’ further grants you a license to access and use the Services, subject to and conditioned upon your compliance with this Agreement, the Privacy Policy, and any other rules and requirements communicated to you by ‘Wujj’, including your payment of any applicable fees. You acknowledge and agree that ‘Wujj’ may modify, update, and otherwise change the Services at any time and in its sole discretion.
You represent and warrant that you are at least 18 years of age and have the legal authority to accept this Agreement on your behalf or on behalf of any party you represent. You alone are responsible for your activities and interaction with the Services.
You shall not use the Services for any purposes beyond the scope of the access granted in this Agreement. You shall not at any time, directly or indirectly, and shall not permit any third-party to: (i) copy, modify, or create derivative works of the Services, in whole or in part; (ii) reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any Mobile App component of the Services, in whole or in part; or (iii) use the Services in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person (including but not limited to web scraping), or that otherwise violates any law, regulation, or other legal requirement.
Purchases are intended for you as the end user only and are not authorized for resale, without Wujj’s express authorization. We reserve the right to refuse or cancel your order if we suspect you are purchasing Services for resale. Title for Products purchased from ‘Wujj’ passes to you at the time of delivery by ‘Wujj’ or our designated carrier.
Except for the limited license to access the Mobile App and Hardware Device identified above, you acknowledge that nothing contained in this Agreement shall be construed as granting or conferring, by implication, estoppel, or otherwise, any right, title, or interest to any intellectual property, including any (i) inventions (whether patentable or not in any country), patents, patent applications, invention disclosures, improvements, trade secrets, proprietary information, know how, information, or technical data; (ii) copyright protected works, copyright registrations, mask works, mask work registrations, or applications in the United States or any foreign country; (iii) trademarks, trademark registrations, service marks, logos, or applications therefore in the United States or any foreign country; (iv) trade secrets; or (v) any other tangible or intangible proprietary rights anywhere in the world.
You acknowledge and agree that at times the Services may be inaccessible or inoperable for any reason whatsoever, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs which ‘Wujj’ may undertake from time to time without notice to you; or (iii) causes which are beyond the control of ‘Wujj’ which are not reasonably foreseeable.
Notwithstanding anything to the contrary in this Agreement, ‘Wujj’ may temporarily suspend access to the Services provided to you and any other third-party for security purposes, to prevent illegal or fraudulent activity, to comply with the requests of any legal agency or government entity, or if you violate the Agreement or the Privacy Policy.
‘Wujj’ may from time to time and in its sole discretion engage other service providers to assist in the performance of the Services, such as web hosting providers, payment processors, and other third-parties. You shall abide by the terms of use and other requirements associated with the services provided by such third-parties in connection with the Services.
Any Restrictions that may occur while using Wujj/Access/Use of Wujj
You may only connect to the “Wujj Service” using (i) a device that is manufactured, distributed, or sold by ‘Wujj’ itself or through its authorized resellers or agents; (ii) our mobile applications and software, or approved third-party applications, software, or devices; or (iii) our websites (“Authorized Connections”). You may not connect to the “Wujj Service” with any device that is not manufactured, distributed, or sold by ‘Wujj’ itself or through its authorized resellers or agents (such as a knock off or counterfeit version of a‘Wujj’ device); otherwise intends to resemble or purports to be a‘Wujj’ device; or any unauthorized application or third-party connection. Any violation or attempted violation of this provision may result in the immediate termination of your ability to access the “Wujj Service”.
Guideline for Wujj Account Uses
Full use of the “Wujj Service”requires that you use an account. You are responsible for all activity that occurs in association with your account. ‘Wujj’ is not liable for any loss or damages caused by your failure to maintain the confidentiality of your account credentials. Please contact Customer Support if you discover or suspect any security breach related to the “Wujj Service” or your account.
Equipment Needed For Wujj
Full use of the “Wujj Service” is dependent upon your use of a supported mobile device, Internet access, and hardware device. The maintenance and security of this equipment may influence the performance of the “Wujj Service” and it is your responsibility to ensure the equipment’s functionality. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges.
Content Usage of Wujj
‘Wujj’ may enable you to post, upload, store, share, send, or display photos, images, video, data, text, music, exercise regimens, food logs, recipes, comments, and other information and content (“Your Content”) to and via the“Wujj Service”. You retain all rights to Your Content that you post to the “Wujj Service”. By making Your Content available on or through the “Wujj Service” you hereby grant to ‘Wujj’ a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, publicly display, publicly perform, reproduce, translate, create derivative works from, and distribute Your Content, in whole or in part, including your name and likeness, in any media. The rights you grant us are only for the limited purpose of offering and improving the “Wujj Service”.
You are responsible for Your Content. You represent and warrant that you own Your Content or that you have all rights necessary to grant us a license to use Your Content as described in these Terms.
You represent and warrant that Your Content, the use and provision of Your Content on the “Wujj Service”, and your use of the “Wujj Service” will not (a) infringe, misappropriate, or violate a third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy; (b) violate, or encourage any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (c) be fraudulent, false, misleading, or deceptive; (d) be defamatory, obscene, pornographic, vulgar, or offensive; (e) promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group; (f) be violent or threatening or promote violence or actions that are threatening to any person or entity; or (g) promote illegal or harmful activities or substances.
You further agree not to (1) upload any content that contains software viruses or is designed to interrupt, destroy, or limit the functionality of any equipment or services, or that contains other harmful, disruptive, or destructive files or content; (2) use or attempt to use another user’s account without authorization, or impersonate any person or entity; (3) harvest, solicit, or collect information of other users for any reason whatsoever, including, without limitation, for sending unsolicited communications; (4) post, advertise, or promote products or services commercially, or upload any content that is advertising, promotional material, junk mail, spam, or a contest or sweepstake, or that furthers or promotes criminal activity; or (5) use the “Wujj Service” in any manner that, in our sole discretion, is objectionable or restricts or inhibits any other person from using or enjoying the “Wujj Service”, or which may expose us or our users to any harm or liability of any type.
‘Wujj’ may, in its sole discretion, alter, remove, or refuse to display any of Your Content, and may forbid you from posting, uploading, storing, sharing, sending, or displaying Your Content to and via the “Wujj Service”.
Intention Of Wujj Usage
The “Wujj Service” is intended for your personal, noncommercial use.
‘Wujj’ grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to (1) access and use the “Wujj Service”, (2) access and view the “Wujj Content”, (3) access and use the software and mobile applications provided by the “Wujj Service”, and (4) use the software that is embedded into ‘Wujj’ devices as authorized in these Terms. With respect to items (3) and (4), this license includes any third-party software embedded in any “Wujj Service”. This license is provided solely for your personal, noncommercial use and enjoyment of the “Wujj Service” as permitted in these Terms.
You will not use, sublicense, copy, adapt, modify, translate, disclose, prepare derivative works based upon, distribute, license, sell, rent, lease, assign, transfer, publicly display, publicly perform, transmit, broadcast, or otherwise exploit the “Wujj Content”, “Wujj Service” or any portion thereof (including any third-party software), except as expressly permitted in these Terms. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by ‘Wujj’ or its licensors, except for the licenses and rights expressly granted in these Terms.
Except to the extent permitted by law, you may not perform, attempt to perform, or encourage or assist others in performing any of the following while accessing or using the “Wujj Service” : (1) use, display, mirror, or frame the “Wujj Service” or any individual element within the “Wujj Service”, including the layout and design of any page, without Wujj’s express written consent; (2) use Wujj’s name, any ‘Wujj’ trademark or logo, or any ‘Wujj’ proprietary information without Wujj’s express written consent; (3) access or tamper with non-public areas of the “Wujj Service”, Wujj’s computer systems, or the technical delivery systems of Wujj’s providers; (4) test the vulnerability of any ‘Wujj’ system or breach any security or authentication measures; (5) circumvent any technological measure implemented by‘Wujj’ or any of Wujj’s providers or any other third party (including another user) to protect the “Wujj Service”; (6) access the “Wujj Service” or Wujj Content through the use of any mechanism other than through the use of an Authorized Connection,“Wujj Service”, or Wujj API; or (7) modify, decompile, disassemble, reverse engineer, tamper with, or otherwise attempt to derive the source code of any software or hardware that ‘Wujj’ provides to you or any other part of the “Wujj Service”.
Customer Responsibilities
You acknowledge that you are solely responsible and liable for your use of the Services, directly or indirectly, including understanding whether such access or use is permitted by or in violation of this Agreement. You are further solely responsible for compliance with all applicable laws relating to your use of the Services. You shall further use the Services solely for lawful purposes, and shall conduct all business through the Services in accordance with all applicable laws and regulations, including but not limited to all applicable federal and state laws and regulations governing the offer and sale of securities, money laundering, and counter-terrorism.
You alone are responsible for ensuring and maintaining that you are able to access and use the Services, including by securing your own compatible hardware, Mobile App, internet access, security Mobile App, backup devices or services, and any other requirements. ‘Wujj’ shall have no responsibility to provide any additional Mobile App or hardware. You further agree that ‘Wujj’ shall have no responsibility for any data loss or other damage or loss suffered in connection with your use of the Services, including any failure to provide adequate security or backup devices or services.
You are responsible for ensuring ‘Wujj’ has accurate and current information for your Customer account, including current contact and payment information. You are further responsible for regularly reviewing the associated Customer email account for any communications from ‘Wujj’.
If you are provided with a username, password, credentials file, or any other piece of information as part of any security procedure (“Credentials”), you must treat such information as confidential, and must not disclose Credentials to any other person or entity. You acknowledge that your account and Credentials are personal to you, and further agree not to provide any other person with access to the Services or portions of the Services using your username, password, or other security information. You shall notify ‘Wujj’ immediately of any unauthorized access to or use of your Credentials or any other breach of security. ‘Wujj’ has the right to disable any username, password, credentials file, or other identifier at any time, whether chosen by you or provided by ‘Wujj’.
‘Wujj’ shall make commercially reasonable efforts to provide adequate support services for the Services. Notwithstanding the foregoing, this Agreement does not entitle you to any guaranteed level, availability, or turnaround time of support services for the Services.
Notifications & Alerts
As part of your use of the “Wujj Service”, you may receive notifications, text messages, alerts, emails, and other electronic communications. You agree to the receipt of these communications. You can control most communications from the “Wujj Service” by using your account settings. We may need to provide you with certain communications, such as service announcements and administrative messages. You are responsible for any messaging or data fees you may be charged by your wireless carrier. Any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that the communication be in writing.
Intellectual Property Rights of Wujj
‘Wujj’ is a trademark of Wujj, Inc. ‘Wujj’ Content, ‘Wujj’ Products, ‘Wujj’ features and Services, and our underlying technology are protected by copyright, trademark, patent, intellectual property, and other laws of the United States and foreign countries. All rights reserved. You are not granted, by implication or otherwise, any license or right to use any marks appearing on, or used or displayed in connection with, the Services (“Trademarks”). The Services may also contain or refer to third-party trademarks, trade names, product names, and logos that may be registered trademarks of their respective owners. Under no circumstances may you use or copy any of the Trademarks. Nothing herein should be construed as granting any license or right to use any Trademarks displayed in connection with the Services without Wujj’s express written permission.
All content provided in association with the Services and this Agreement, including, but not limited to, the Site, the Product, the Mobile App, all text, graphics, user interfaces, visual interfaces, photographs, images/video, electronic art, sounds/audio, data, communications programs, executable code, computer code, and data (collectively, “Content”) formatted, organized, and collected in a variety of forms, including design, structure, selection, coordination, expression, “look and feel,” arrangement, layouts, pages, screens, and databases of such Content, contained in the Content, Services, and underlying technology, and any and all other copyright-protected work associated with the Services (“Copyrighted Works”), are exclusively owned, controlled, or licensed by or to ‘Wujj’ and are protected by U.S. and international copyright laws. You agree you will not directly or indirectly copy, reproduce, modify, create derivative works from, distribute, or publicly display the Copyrighted Works without the prior express written permission of ‘Wujj’.
If you provide any communications or materials to ‘Wujj’ by mail, email, telephone, or otherwise, suggesting or recommending changes to the Services, including without limitation, new features or functionality relating thereto, or any comments, questions, suggestions, or the like (“Feedback”), ‘Wujj’ is free to use such Feedback irrespective of any other obligation or limitation between the Parties governing such Feedback.‘Wujj’ is free to use, without any attribution or compensation to any party, any ideas, know-how, concepts, techniques, or other intellectual property rights contained in the Feedback, for any purpose whatsoever, although ‘Wujj’ is not required to use any Feedback.
‘Wujj’ respects the intellectual property rights of others and it is our policy to expeditiously process and review notices of claimed infringement of copyright or other applicable intellectual property laws. Any notices of claimed infringement should be sent to Wujj’s Designated Agent at [penda@improhoe.com], and must contain all of the following: (i) a signature (physical or electronic) of the copyright owner or a person authorized to act on behalf of the copyright owner; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of the material that you claim is infringing and is to be removed or have access to same disabled, and information sufficient to permit Wujj’s administrators to locate the material; (iv) information sufficient for us to contact you, such as address, telephone number, and email address; (v) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of a copyright that is allegedly infringed.
Limitation of Liability
IN NO EVENT WILL WUJJ, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, PARTNERS, AND LICENSORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES OR ANY CONTENT ASSOCIATED WITH THE SERVICES, OR SUCH OTHER SITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF BUSINESS OPPORTUNITY, BUSINESS INTERRUPTION, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. THESE EXCLUSIONS OR LIMITATIONS WILL APPLY REGARDLESS OF WHETHER OR NOT WUJJ HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED OR LIMITED AS SET FORTH ABOVE, IN NO EVENT SHALL WUJJ BE LIABLE FOR ANY CLAIM, WHETHER IN CONTRACT, TORT, OR UNDER ANY OTHER THEORY OF LIABILITY, IN EXCESS OF $100.

At ‘Wujj’, we take the protection of your personal data seriously. This Privacy Policy applies to processing of personal data by ‘Wujj’.
‘Wujj’ collects and processes the personal data of Device & Application Users ("Users") for the following purposes:
To provide ‘Wujj’ services
We process personal data to provide ‘Wujj’ services and app features, such as to provide you with daily insights about your readiness, activity, and other inferences about your arousal status.To provide customer service
We process personal data for the purpose of providing customer service and managing our customer communication. If you contact our Support with questions regarding your app data, we may use the provided information to answer your questions and for solving any issues you may have.To develop our products and services
We process data regarding your use of the ‘Wujj’ device and platform to improve our services and features, such as in the ‘Wujj’ App. When feasible, we will do this using only pseudonymized, aggregated, or non-personally identifiable data.To market our products and services
We process marketing-related data to provide online advertising and ‘Wujj’ marketing communications.To enable third party integrations and services
We process data you provide to ‘Wujj’ to enable third party integrations, services, features, and offerings. Examples of third parties we partner with include research partners, Google Fit, or Apple Health. Wujj takes measures to help ensure third party services protect your personal data, which means receipt and transmission of your data to and from third party services is undertaken when you have provided ‘Wujj’ with the necessary consents.To comply with legal obligations
In certain cases, we must process certain data when it is required by applicable laws and regulations. Such statutory obligations are related, for example, to accounting and tax requirements, legal claims, or other legal purposes. ‘Wujj’ will oppose any request to provide legal authorities with access to user data for surveillance or prosecution purposes, and will notify users if we receive any such request.
In most cases,‘Wujj’ collects personal data directly from you, such as when you register for an account, tag your data in the app, or use your ‘Wujj’ device to collect data via the functions of ‘Wujj’. We may also process data that is produced from the information you provide to us. ‘Wujj’ may also rely on trusted third party processors to collect data on our behalf.
‘Wujj’ processes the following personal data categories about device and application Users:
Contact information such as email address or physical address.
User information such as gender, health status, User ID, and other information you may provide to us about yourself or your account.
Device information such as IP address and location data.
User-provided activity and contextual information such as the activities, notes, comments, and tags you provide within the app.
Measured data such as heart rate, pelvic contractions, and temperature data.
Calculated user, health, and activity data such as activity levels throughout the day, readiness level.
Please note that some of the personal data we process, including any data concerning your health, is considered special or sensitive personal data. Under applicable law, such data is processed only if you have given your consent for processing.
‘Wujj’ does not sell or rent your personal information, and only shares your personal data with certain trusted service providers and partners so that we can provide and improve our services, to provide partner services and other offerings, and to operate our business. Whenever we share data with third-party service providers, we require that they use your information only for the purposes we've authorized, and for the limited reasons explained in this Privacy Policy. We also require these service providers to protect your personal information to at least the same standards that we do.
Like most companies, ‘Wujj’ uses service providers for purposes such as:
providing and improving our online service platform;
storing our users' data;
providing customer services;
managing and organizing our marketing activities. ‘Wujj’ only shares website usage data with our advertising network partners for the purposes of analyzing and optimizing our marketing. ‘Wujj’ does not share the ‘Wujj’ App data with third party advertisers; and
analyzing information regarding the use of our online service to improve our service quality.
‘Wujj’ stores personal data primarily within the geographic region in which it is collected. In cases where personal data is processed outside of the area in which it was collected, we always ensure your personal data is protected with appropriate safeguards in accordance with applicable privacy laws. We also use industry standard data protection measures to safeguard all international transfers of personal data through data protection agreements with our service providers.
We also reserve the right to disclose personal information under certain specific circumstances, including:
When we have your express consent to do so;
When it is reasonably necessary for our legitimate interests in conducting our business, such as in the event a merger, acquisition, or sale;
To protect Wujj's legal rights and property; and
To comply with valid legal requirements. ‘Wujj’ will oppose any request to provide legal authorities with access to user data for surveillance or prosecution purposes, and will notify users if we receive any such request.
Otherwise, your personal information is never shared with any individual or other organization.
‘Wujj’ uses technical and organizational safeguards to keep your data safe and secure. When appropriate, these safeguards include measures such as anonymization or pseudonymization of personal data, strict access control, and the use of encryption to protect the data we process.
We also ensure that our staff receive adequate training to ensure personal data is processed only in accordance with our internal policies, consistent with our obligations under applicable law. We also limit access to your sensitive personal data to personnel that have specifically been granted such access.
Online services that we provide, such as the ‘Wujj’ App, protect your personal data in-transit using encryption and other security measures. We also regularly test our service, systems, and other assets for possible security vulnerabilities.
We update the ‘Wujj’ App and the ‘Wujj’ device firmware regularly. We recommend that you make sure that you always have the latest app and firmware versions installed in order to maximize protection of your data.
The retention period for your personal data generally depends on the duration of your ‘Wujj’ account lifecycle. Your personal data will be deleted when it is no longer needed for the purpose for which it was originally collected, unless we have a legal obligation to retain data for a longer period of time. For example, your measurement data regarding your arousal, biofeedback, and activity is stored only so long as your ‘Wujj’ account is active.
‘Wujj’ also has legal obligations to retain certain personal data for a specific period of time, such as for tax purposes. These required retention periods may include, for example, accounting and tax requirements, legal claims, or for any other legal purposes. Please note that obligatory retention periods for personal data vary based on the relevant law.

Indemnification of Wujj
You agree to indemnify, hold harmless, and defend ‘Wujj’, its subsidiaries, affiliates, officers, directors, employees, representatives, agents, partners, licensors, successors, and assigns, from and against any action, cause, claim, damage, debt, demand, or liability, including reasonable costs and attorneys’ fees, asserted by any person, arising out of or relating to (i) your use of the Services, including but not limited to anyone using your account or Credentials; (ii) breach of this Agreement by you or anyone using your account or Credentials; (iii) any information used, stored, or transmitted in connection with your account or Credentials; (iv) breach of the rights of any third party, including but not limited to privacy, publicity, intellectual property, or other proprietary rights by you or anyone using your account or Credentials; or (v) violation of any law, regulation, or other legal requirement.
